Behind on Your Mortgage? Here's What You Need to Know

Missed payments are stressful, but foreclosure is not your only story. Understanding the timeline and your options is the first step back to control.

If you have missed a mortgage payment, or two, or more, the first thing to know is that you are not out of options. The second is that time genuinely matters: the earlier you understand where you stand, the more choices you keep. This guide walks through what actually happens, in plain English, so the process stops feeling like something happening to you.

What happens when you miss payments?

Right after a missed payment, the lender typically starts reaching out: calls, letters, and options to catch up. California law requires a specific sequence before a foreclosure can proceed. Missing payments does not mean you lose the home tomorrow. It starts a timeline, and timelines are something you can work with.

What is a Notice of Default?

After roughly three months of missed payments, the lender can record a Notice of Default, the official start of foreclosure proceedings in California. It is a public filing, and it begins a defined period during which you can still act. Receiving one is serious, but it is a deadline to work with, not the end of the story.

What are your options?

  • Catch up the arrears, possibly through a repayment plan with the lender
  • Request a loan modification that changes the terms to a payment you can afford
  • Sell the home before the auction date to control the timing and protect equity
  • Complete a short sale if the home is worth less than what you owe and the lender agrees to accept less
  • Consider a deed in lieu of foreclosure, handing the property to the lender voluntarily

Why acting early matters

Every option above exists on a timeline, and most of them require time to complete. Selling before the auction takes weeks of marketing and paperwork. A short sale can take longer because the lender is involved. The closer you get to the auction date, the fewer choices you have, and the more pressure you feel. Early is always better.

What to watch out for

  • Do not ignore the lender's letters; information is power here
  • Be wary of anyone who charges upfront fees to save your home or promises a guaranteed result
  • Do not make panicked decisions without understanding the full picture first
